Certificates of energy performance of the building and premises

It is a document that specifies the energy requirements necessary to meet the needs associated with the use of a building or part of it. The study relates to heating and ventilation, domestic hot water preparation, cooling and built-in lighting (in the case of non-residential buildings).

The obligation to have a certificate of energy performance of a building or part of a building in certain situations arises from European law. With the information contained in the certificate, the owner, tenant or user of the building can determine the approximate annual energy demand and maintenance costs.

From April 2023, the investor is obliged to attach the energy performance certificate to the notice of completion of the construction of the building or to the application for a permit for use. Excluded from this obligation are houses up to 70 m2 of built-up for their own residential purposes. If the sale/lease concerns a building, a certificate of energy performance of the building should be drawn up, while if the sale/lease concerns a part of the building (premises), a certificate of energy performance of a specific part of the property should be drawn up.

The buyer or tenant may not waive the right to receive a certificate. In the absence of a certificate of energy performance when renting or selling real estate, there is a risk of a fine. The notary's instruction on the sanction will be in any notarial deed to which the certificate is not provided.

The energy performance certificate is valid for 10 years from the date of its preparation. Certificates issued before the entry into force of the Energy Performance of Buildings Act (28 April 2023) will remain valid for the period for which they were drawn up. The certificate will expire before the expiry of this period if construction and installation works are carried out, as a result of which the energy characteristics of the building or part of the building will change (e.g. replacement of windows, replacement of heat source, insulation of the building).

Key data are: information that uniquely identifies the object (address, usable area), architectural documentation (plans, sections, construction of partitions) and characteristics of individual systems in the building (central heating, hot water, ventilation, lighting, etc.).

The obligation to draw up a certificate covers real estate or premises that are sold or rented. For newly built facilities, the obligation arises at the time of completion of their construction, as well as in the case of joining part of the programs financing investments, for example, an ecological loan.

The price of the building energy certificate is determined on the basis of a preliminary assessment of the complexity of the construction of the building or its area. Usually, however, these prices start from a few hundred zlotys for objects with an area of several tens of square meters.

It is valid for 10 years from the moment of its preparation, however, with the proviso that it loses its validity as a result of interference with the property, which will affect the current state of the building's energy demand. These are all types of thermo-modernization works such as, for example, insulation of external partitions or replacement of central heating systems.

Such studies may be drawn up by persons who have an entry in the list of persons entitled to draw up energy performance certificates. Such an entry can be received by a person who has not been convicted by a final judgment for crimes specified in the Act, and also has a building permit or has completed higher studies with a degree in engineering or other courses directly related to the topic of energy performance of buildings.
